It has been reported that the NSA deleted data files that they were court ordered to hold due to pending lawsuits. The files in question were a part of the G. W. Bush spying program. If we run down timeline regarding this data, you can clearly see that the NSA had enough time to prevent the deletion of the data in question:
March 7, 2014 US Foreign Intelligence Surveillance Court Judge (Reggie) Watson ordered that the NSA could not keep data past 5 years.
March 10, 2014 United States District Judge (Jeffrey S) White ordered a temporary restraining order against the NSA preventing them from destroying any telephone metadata or “call detail” records “relevant to claims”.
Deputy Director of Capabilities, Elizabeth B (last name is blocked out of legal document) stated in this court document, dated October 4, 2017, that the NSA was aware that the files that in which they were court ordered to preserve had been deleted and they’re sorry” about this (really?).
On January 17th, Chief of Compliance Capabilities, Dr. Mark L (last name is blocked out in legal document) basically said “Opps Our Bad, we accidentally deleted the data during a broad housecleaning effort aimed towards making space for incoming information” in a legal document sent to the courts about the data deletion. In this document, the NSA is claiming that they are trying to restore that data as seen here (copied from legal document)
“Among the data sets already searched are the metadata extracted from online communications collected by the NSA during the PSP. As previously described in the Declaration of Elizabeth B. (ECF No. 379-2), the NSA failed to prevent the deletion of certain PSP Internet content data, and is currently undertaking efforts to restore as much of this data as possible. The deletion of this data has not substantially affected the NSA’s ability to determine whether Plaintiffs’ Internet communications were collected as part of the PSP content collection, however, because the NSA has preserved certain metadata extracted from PSP Internet content data, metadata it has now searched for Plaintiffs’ identifiers”Wochit News tried to bring coverage to this as seen here in their YouTube video:
There are 3 days difference from the time of the NSA being ordered to delete data to being ordered not delete data, but 10 years later it comes out that it was deleted… So are they saying that they got ordered not to delete this data and nothing magically went right? Not only did they fail to perform correctly but the backup tapes that might have mitigated this failure were erased in 2009, 2011 and 2011… So it just all gone… This makes us ask WHY? Why this
data and why now? Do you think this just an accident? Do you think that this is something NSA did on purpose?
